The terms and conditions of the Ticket Reservation within the on-line system www.e-ticket.pl Reservation and distribution of tickets¾Regulations Any person willing to make use of the on-line system of ticket reservation and pre-sale is obliged to acknowledge these below Regulations. Acceptance of Reservation (submitting the Reservation Form) shall be unequivocal with obeying these Regulations. Definitions: 1. SYSTEM ¾a system of "Ticket-Reservation and Pre-sale" available on the web-site: www.e-ticket.pl 2. ORGANISER ¾an economic entity in possession of rights to distribute tickets for the customer-chosen event (within SYSTEM) 3. CUSTOMER ¾a person making a reservation within SYSTEM. 4. PERSONAL ACCESS-CODE¾a original number enabling CUSTOMER to monitor their reservation at any time chosen. General Rules: 1. Reservation within SYSTEM shall be made by filling and submitting Reservation Form 2. Ticket types and prices for a given event shall be stipulated by ORGANISER. Reservation and sale of tickets shall be performed in the Polish currency (Zloty PLN), and the Euro prices and values shall be of guiding function only. The prices shall be counted over in accordance with an oriented exchange rate. 3. Prices stated shall be gross prices, and they shall include VAT of tax-rate stipulated by relevant regulations. 4. After entering Reservation Program and choosing the event, it is necessary to get familiarised with the ticket offer. The total number of tickets shall be defined by CUSTOMER by inserting the specified number of tickets in a field located next to the chosen ticket-type, and in case of numbered seats indicated by the seat-numbers chosen. Numbered seats shall be accredited to CUSTOMER following their completion of payment within a specified date. In case of presenting their e-mail address in Reservation Form, CUSTOMER shall be immediately delivered a confirmation-notice of validated transaction, stating types of the tickets and the seat-numbers. 5. Accommodation may also be arranged with the usage of SYSTEM. In such case CUSTOMER may choose accommodation they opt for by accepting the price. The price shall be added up to the total value of transaction. Accommodation shall be confirmed subsequent to the payment. 6. Value of the requested tickets may at each and every time be checked with clicking COUNT OVER. Total value of ticket payment in the sales system may be of lower charge than the price of ORGANISER, for the reason that SYSTEM shall automatically include discount offered to CUSTOMER for forward reservation and on-line purchase. Discounts introduced may differ, and be in force within limited promotion periods only. 7. Having chosen ticket-types, CUSTOMER shall fill Reservation Form. 8. After accepting transaction, Reservation Form shall be sent further on, and CUSTOMER'S data, incl. personal data, tickets ordered, and account number in case of cash-flow paying CUSTOMERS, as well as PERSONAL ACCESS CODE, shall be displayed on screen. Should CUSTOMER'S e-mail address be stated in Reservation Form, all on-screen data shall be automatically sent onto the said e-mail address. It shall also be the said to which SYSTEM send ORGANISER'S information concerning confirmation of payment-reception. On the grounds of safety and correctness, the e-mail address should be entered twice. 9. No payment at defined date shall automatically cancel the reservation. Customer's Personal Access Code: 1. CUSTOMER WITHIN SYSTEM shall be granted permanent access to their reservation with the use of "Your Reservation" option. After inserting their PERSONAL ACCESS CODE, CUSTOMER'S current reservation status may be checked. Access link to this option may be found on Main Page of SYSTEM (www.e-ticket.pl). 2. PERSONAL ACCESS CODE shall be generated following the process of reservation (it should be written down off-screen or remembered from message sent to the stated e-mail address). 3. CUSTOMERS shall be obliged to secure their PERSONAL ACCESS CODE and not to take any actions aiming at or resulting in cracking the codes of other CUSTOMERS WITHIN SYSTEM. Conditions for Reservation: 1. Reservation may be made via the internet only. 2. Each and every person¾acting in accordance with SYSTEM and these Regulations¾shall be allowed to make a reservation using the electronic system. ORGANISER shall assume that each and every customer within SYSTEM shall operate it properly, and for actual ticket reservation only, and that they shall present genuine data. 3. Consequences resulting from faulty data presentation shall fully be ascribed to CUSTOMER. 4. It shall also be CUSTOMER who should be held responsible for retaining data required for their unequivocal and unimpeded identification. ORGANISER cannot be held responsible for results of CUSTOMER'S revealing their data to a third party. Form and conditions of payment: 1. CREDIT CARD PAYMENT Authorisation and financial operations shall be carried by means of a terminal located on SYSTEM'S web-site through a direct connection with PolCard Company server by a 128-bit encoded protocol. Financial operations shall be carried in the Polish currency (Z³oty PLN). In case of payment outside the Republic of Poland, the value of transaction shall be deduced in accordance with official exchange rate at the day of transaction. 2. BANK-TRANSFER PAYMENT CUSTOMER shall be obliged to make a money-transfer within a time-period specified by SYSTEM. The account number shall be displayed on screen following the conclusion of the process of reservation. Should there be stated CUSTOMER'S e-mail address in Reservation Form, SYSTEM shall automatically send information concerning validation of the transaction, and shall specify the conditions of payment. Ticket Reception: 1. In Reservation Form ORGANISER shall specify conditions of delivery/reception of paid tickets. 2. CUSTOMER shall be suggested possible ways of ticket-reception: - Reception prior to event at KASA INFO (ticket-office) designed especially for this purpose - Courier delivery chargeable to CUSTOMER - Other, defined by ORGANISER All necessary information concerning ways of ticket-reception chosen by CUSTOMER shall be displayed on screen, and provided that CUSTOMER present their e-mail address, sent to them concurrently with reservation confirmation. 3. In case of return of courier delivery, tickets shall be directed to be collected at KASA INFO (ticket-office). That being the case, CUSTOMER shall not be reimbursed courier delivery expense. VAT-form: 1. CUSTOMER may request making a VAT-form by their marking and filling a field on Reservation Form with all required data. Business name and detailed address of the company, and taxpayer's identification number must be stated. Subsequent to reservation payment, VAT-form shall be sent to address presented by CUSTOMER in Reservation Form in accordance with Polish tax-law regulations. 2. Insufficient data shall be regarded as resignation from VAT-form request. Complaints: 1. CUSTOMER shall be granted right to lodge complaints in case of SYSTEM malfunction. The complaint should be accompanied by problem description and sent to: info @ eurobilet.com 2. In any other case the party at which complaints may be lodged shall be ORGANISER. Term for submitting complaints concerning a given event shall expire subsequent to 7 days starting from the day of event's conclusion. Afterwards, any claims shall not be taken into consideration. 3. ORGANISER shall employ all possible efforts to see that any unforeseen affairs be regarded for the benefit of CUSTOMER, and if possible, with avoidance of additional expenses. Reservation Cancelling: Cancelling of reserved or paid tickets shall be possible pursuant to the below conditions: - CUSTOMER made no payment onto ORGANISER'S account within period stated by SYSTEM. Cancelling shall bring no charge to CUSTOMER whatsoever. - CUSTOMER made payment within amount required by SYSTEM. Ticket payment shall not be returnable. - CUSTOMER made payment of amount smaller than required by SYSTEM, which shall then break the agreement due to CUSTOMER'S fault in failing to comply with terms and conditions of reservation. CUSTOMER may pay up to the full price of reservation. Conclusion: 1. Money transfers onto ORGANISER'S account within defined date and of value required in reservation shall represent a validation of purchase/sale contract between CUSTOMER and ORGANISER. 2. The date, the place, and means of ticket distribution shall be determined by ORGANISER. 3. In case of event cancellation or rearrangement of its date, further ticket distribution shall be held in accordance with internal sales regulations executed by main ticket-offices of ORGANISER. 4. Complaints concerning no payment may be lodged only subsequent to four working days (starting from the date of the required payment) stating the number of reservation. 5. Correspondence with CUSTOMER shall be carried via electronic mail only. It shall be CUSTOMER who shall be liable for any consequences of their stating an incorrect e-mail address. 6. Personal data of CUSTOMER shall be utilised within performed activity only. CUSTOMER shall be granted the right to view and modify their personal data. These data shall be subject to protection pursuant to the Law of the Personal Data Protection (Journal of Laws No. 133/1997, item 833 as amended) 7. In case of disagreement between ORGANISER and CUSTOMER, the court proper to arrive at a verdict shall be the community-court in accordance with the registered seat of ORGANISER. 8. Any changes made on payed reservation/tickets will be charged 35 z³ (~ 10 euro). 9. There are no pay back of card provisions, taxes and other provisions. 10.Publication or any other operation performed upon these Regulations as a whole, or a part of it, without a written consent, is forbidden. Rules of responsibility: 1. ORGANISER shall guarantee that each and every person making reservation within SYSTEM, and setting up with full payment in due time, shall receive the adequate ticket allowing them to enter the given event. 2. In case of external higher forces, independent from either of the parties (natural disasters, strikes, wars, or any other situations making the realisation of the offer impossible to fulfil), ORGANISER shall have the right to refrain from this agreement. 3. ORGANISER cannot be held responsible for SYSTEM malfunctioning. 4. ORGANISER shall be entitled to limit or restrict access to SYSTEM without presenting explicit reasoning.
